Pero el funcionariado estatal quiere dejar en claro una cosa: sin importar su estatus migratorio, sus derechos deben hacerse respetar.<\/p>\n\n\n\n<p>\u201cEl estatus migratorio no afecta sus garant\u00edas laborales\u201d, asegura Lilia Garc\u00eda-Brower, Comisionada Laboral de California, \u201cSi usted ejecuta un trabajo, debe recibir su pago como corresponde\u201d.<\/p>\n\n\n\n<p>Presentar un reclamo es m\u00e1s f\u00e1cil de lo que se cree. Las personas trabajadoras que no han recibido su salario o hayan sufrido represalias pueden presentar una queja a trav\u00e9s de varios recursos:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Por internet: <a href=\"http:\/\/robodesueldoesuncrimen.com\/\">RobodelSueldoEsUnCrimen<\/a><\/li>\n\n\n\n<li>En persona: En la Comisi\u00f3n Laboral, en su sede <a href=\"https:\/\/www.dir.ca.gov\/dlse\/DistrictOffices.htm\">San Francisco<\/a> (455 Golden Gate Ave., piso 9).<\/li>\n\n\n\n<li>Mediante una organizaci\u00f3n comunitaria: <a href=\"https:\/\/www.lrcl.org\/\">La Raza Centro Legal<\/a>, que brinda asistencia directa.<\/li>\n<\/ul>\n\n\n\n<p>Garc\u00eda-Brower hace un llamado a las personas trabajadoras migrantes a \u201csalir de las sombras\u201d, y hacer uso de esos recursos que est\u00e1n garantizados por la ley estatal. Es importante que estas personas sepan que:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La Comisi\u00f3n Laboral no preguntar\u00e1 sobre el estatus legal de la persona al momento de presentar una queja.<\/li>\n\n\n\n<li>Las represalias son ilegales: si la persona empleadora amenaza o castiga a sus personas empleadas por denunciar, puede ser multada con hasta $10 mil por <a href=\"http:\/\/dir.ca.gov\/DIRNews\/2025\/Spanish\/2025-53.html\">incidente<\/a>.<\/li>\n\n\n\n<li>Tus derechos laborales no se pierden. Es ilegal que la persona empleadora use al ICE o la deportaci\u00f3n como un arma para intimidar y eliminar los derechos de sus personas empleadas.<\/li>\n\n\n\n<li>Las inspecciones en el lugar de trabajo deben ser transparentes: la persona empleadora debe avisar, con al menos 72 horas de anticipaci\u00f3n, si recibe una <a href=\"https:\/\/oag.ca.gov\/sites\/all\/files\/agweb\/pdfs\/immigrants\/immigration-ab450.pdf\">notificaci\u00f3n de inspecci\u00f3n de migraci\u00f3n<\/a>.<\/li>\n<\/ul>\n\n\n\n<p>Durante los seis a\u00f1os que ha fungido como Comisionada Laboral, la oficina de Garc\u00eda-Brower recuper\u00f3 millones de d\u00f3lares para las personas trabajadoras en casos de robo de salarios, seg\u00fan el Departamento de Relaciones Industriales, que supervisa la Comisi\u00f3n Laboral.<\/p>\n\n\n\n<p>Esa oficina dice que las quejas exitosas son aquellas que documentan muy bien sus reclamos, para ello:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Escribe el nombre de la persona para la cual hayas trabajado (nombre, direcci\u00f3n, tel\u00e9fono, de ser posible).<\/li>\n\n\n\n<li>Lleva un registro de las horas, fechas, salario no pagado, en papel o en tu tel\u00e9fono.<\/li>\n\n\n\n<li>Documenta el qui\u00e9n, cu\u00e1ndo, qu\u00e9, d\u00f3nde y c\u00f3mo del trabajo que hayas realizado.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>\u201cLas personas empleadoras predatorias quieren mantener a sus personas empleadas ignorantes y aisladas\u201d, afirma Garc\u00eda-Brower. \u201cHazte ver\u201d.<\/p>\n\n\n\n<p><strong>M\u00e1s sobre la fuerza laboral migrante&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/eltecolote.org\/content\/es\/sf-migrantes-fuerza-laboral-discapacidad\/\">Un migrante vino por trabajo a San Francisco. In addition, throughout her career in San Francisco, California, Katie has actively collaborated with various nonprofit organizations to support the immigrant community. Her contributions have been key in editing and producing content, as well as in disseminating vital information for monolingual Spanish-speaking Latinos, helping facilitate access to essential resources and empowering the communities she serves. As of August, Katie Beas has taken on the role of Managing Editor of El Tecolote. Her mission is to strengthen the newspaper\u2019s connection with San Francisco\u2019s migrant and Latino communities through bilingual service journalism.
