But state officials want workers to know one thing clearly: your rights don\u2019t disappear because of your status.<\/p>\n\n\n\n<p>\u201cImmigration status has no influence on your protections as a worker,\u201d said Lilia Garc\u00eda-Brower, California\u2019s Labor Commissioner. \u201cIf you provide labor, you have to be paid legally.\u201d<\/p>\n\n\n\n<p>Filing a claim is easier than you think. Workers who are unpaid or retaliated against can file a complaint through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Online: <a href=\"http:\/\/wagetheftisacrime.com\">WageTheftIsACrime.com<\/a><\/li>\n\n\n\n<li>In person: At the Labor Commissioner\u2019s <a href=\"https:\/\/www.dir.ca.gov\/dlse\/DistrictOffices.htm\">San Francisco office<\/a> (455 Golden Gate Ave., 9th Floor)<\/li>\n\n\n\n<li>Community partner: La Raza Centro Legal, which assists workers directly<\/li>\n<\/ul>\n\n\n\n<p>Garc\u00eda-Brower urges immigrants to \u201ccome out of the shadows,\u201d and use these resources, which are guaranteed by California law. In particular, immigrants should know:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Labor Commissioner\u2019s office will not ask about your status when you file a complaint.<\/li>\n\n\n\n<li>Retaliation is illegal. Employers who threaten or punish workers for speaking up can face penalties up to $10,000 per <a href=\"http:\/\/dir.ca.gov\/DIRNews\/2025\/Spanish\/2025-53.html\">incident<\/a>.<\/li>\n\n\n\n<li><a href=\"https:\/\/dir.ca.gov\/DIRNews\/2025\/2025-53.html\">Immigration threats<\/a> don\u2019t erase rights. Using ICE or deportation as a weapon against workers is against the law.<\/li>\n\n\n\n<li>Worksite inspections must be transparent. Employers must notify workers within 72 hours after receiving notice of an <a href=\"https:\/\/oag.ca.gov\/sites\/all\/files\/agweb\/pdfs\/immigrants\/immigration-ab450.pdf\">immigration inspection<\/a>.<\/li>\n<\/ul>\n\n\n\n<p>During her six-year tenure as Labor Commissioner, Garc\u00eda-Brower\u2019s office recovered millions of dollars for workers in cases of wage theft, according to the Department of Industrial Relations, which oversees the Labor Commission.&nbsp;<\/p>\n\n\n\n<p>The Commissioner\u2019s office says the most successful claims are well-documented:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Write down who you worked for (name, address, phone if possible)<\/li>\n\n\n\n<li>Track your hours, dates and wages owed, even on your phone<\/li>\n\n\n\n<li>Document the who, what, where, when and why of the work performed<\/li>\n<\/ul>\n\n\n\n<p>\u201cPredatory employers want to keep workers ignorant and isolated,\u201d Garc\u00eda-Brower said. \u201cMake yourself be seen.\u201d<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity is-style-wide\"\/>\n\n\n\n<p><strong>More on day laborers<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/eltecolote.org\/content\/en\/sf-ice-immigrant-workers-jobs\/\">ICE fears and loss of work hit San Francisco\u2019s day laborers hard<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/eltecolote.org\/content\/en\/sf-immigrant-worker-disability\/\">An immigrant came to San Francisco for work.
