{"id":64808,"date":"2025-03-24T18:45:39","date_gmt":"2025-03-25T01:45:39","guid":{"rendered":"https:\/\/eltecolote.org\/content\/?p=64808"},"modified":"2025-09-22T13:54:45","modified_gmt":"2025-09-22T20:54:45","slug":"venezuela-tps-sf-rally","status":"publish","type":"post","link":"https:\/\/eltecolote.org\/content\/en\/venezuela-tps-sf-rally\/","title":{"rendered":"Immigrants rally in S.F. to defend TPS protections for Venezuelans, Haitians"},"content":{"rendered":"\n<p>On Monday, a group of immigration lawyers and individuals with Temporary Protected Status (TPS) asked a federal judge in San Francisco to pause the Trump administration\u2019s decision to end TPS protections for more than one million Venezuelan and Haitian immigrants.<\/p>\n\n\n\n<p>The hearing marked the start of a case challenging the administration\u2019s move to eliminate Venezuelans\u2019 access to TPS\u2014a federal program that grants legal status and work permits to people from certain countries who cannot safely return home. The lawsuit<a href=\"https:\/\/www.aclusocal.org\/en\/press-releases\/tps-holders-challenge-shortening-humanitarian-relief-500000-haitians\"> has since expanded<\/a> to include Haitian TPS holders.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Immigration tracker:<\/strong> <a href=\"https:\/\/eltecolote.org\/content\/en\/trump-immigration-news-2\/\">Latest updates on TPS, asylum and other policy changes<\/a><\/li>\n<\/ul>\n\n\n\n<p>\u201cThe lawsuit we filed, it\u2019s not about an administrative decision,\u201d said Cecilia Gonzalez Herrera, a Venezuelan TPS holder and plaintiff in the case. \u201cIt\u2019s about protecting nearly 600,000 Venezuelans and their families who rely on this safety and stability.\u201d<\/p>\n\n\n\n<p>On Feb. 1, Department of Homeland Security (DHS) Secretary Kristi Noem <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/02\/05\/2025-02294\/termination-of-the-october-3-2023-designation-of-venezuela-for-temporary-protected-status\">revoked a planned<\/a> 18-month extension of TPS for Venezuelans, arguing the move went against the \u201cnational interest of the United States.\u201d The decision could strip 350,000 Venezuelans of their legal status in early April, with another 250,000 facing the same fate by summer, according to the ACLU.&nbsp;<\/p>\n\n\n\n<p>Two weeks later, on Feb. 19, the National TPS Alliance and several Venezuelan TPS holders filed a lawsuit in San Francisco federal court, <a href=\"https:\/\/www.aclusocal.org\/sites\/default\/files\/tps_venezuela_complaint.pdf\">calling the TPS termination<\/a> \u201cunlawful, politically motivated\u201d and \u201cracially biased.\u201d Their suit is supported by the National Day Laborer Organizing Network (NDLON) and the ACLU.<\/p>\n\n\n\n<p>\u201cMake no mistake. This case is about the people,\u201d said Ahilan Arulanantham, a UCLA law professor leading the plaintiffs\u2019 legal team. \u201cIt is about the communities who have so much to offer this country.\u201d<\/p>\n\n\n\n<p>In recent weeks, beneficiaries from more countries have been similarly affected. In late February, DHS announced TPS protections for Haitian immigrants <a href=\"https:\/\/www.google.com\/search?sca_esv=2104b54b03267c45&amp;q=haiti+tps&amp;tbm=nws&amp;source=univ&amp;tbo=u&amp;sa=X&amp;ved=2ahUKEwigocqG_aOMAxXVHzQIHTk8K5IQt8YBKAF6BAgMEAQ&amp;biw=1512&amp;bih=823&amp;dpr=2\">would end by August<\/a>, which could impact up to 500,000 people. On Friday, DHS <a href=\"https:\/\/www.npr.org\/2025\/03\/22\/nx-s1-5337214\/dhs-revokes-humanitarian-parole-cubans-haitians-nicaraguans-venezuelans\">officials <\/a>said that Cuban and Nicaraguan immigrants would also lose humanitarian parole protections this spring.<\/p>\n\n\n\n<p>This isn\u2019t the first time Trump-era officials have attempted to roll back TPS. In 2018, a federal judge <a href=\"https:\/\/www.cnn.com\/2018\/10\/03\/politics\/tps-preliminary-injunction\/index.html\">blocked<\/a> those efforts with a preliminary injunction, responding to a lawsuit by the National TPS Alliance. Advocates now hope for a similar ruling to pause implementation while the court reviews the current case.<\/p>\n\n\n\n<p><strong>Immigrants fight against TPS rollback<\/strong><\/p>\n\n\n\n<p>Before the hearing began, more than 100 immigrants, lawyers and advocates from across the country gathered outside the Phillip Burton Federal Courthouse in downtown San Francisco. Many waved Venezuelan flags and held banners in support of TPS holders, as speakers and musicians shared messages of solidarity.<\/p>\n\n\n\n<p>\u201cWe\u2019re seeing our Venezuelan and Haitian communities get stigmatized in a way we had never seen before,\u201d said Pablo Alvarado, co-executive director of NDLON. \u201cThis isn\u2019t fair. The person who has spent 35 years here and the person who is now crossing the border\u2014we are all worth the same.\u201d<\/p>\n\n\n\n<p>Some Venezuelans said they were frustrated by the way their community has been targeted by <a href=\"https:\/\/www.nytimes.com\/article\/alien-enemies-act-trump.html\">&nbsp;Trump\u2019s immigration crackdown<\/a>, despite having immigrated legally.&nbsp;<\/p>\n\n\n\n<p>\u201cThere\u2019s a lot of racism, a lot of discrimination. I respect that the president came to put things in place,\u201d said Yusnaira M., a TPS holder who flew from Los Angeles for the rally. \u201cBut really, the administration is acting badly. I feel like they\u2019re acting on whims and impulsivity.\u201d<\/p>\n\n\n\n<p>Isaris Pumar, who also flew in from Los Angeles, is a permanent resident, but said many of her family members rely on TPS.<\/p>\n\n\n\n<p>\u201cMany people thought they were supporting a change. But we feel like we were used,\u201d Pumar told El Tecolote. \u201cThere have been so many people who left everything in their country\u2026 many people who haven\u2019t just been here a year but have spent twenty years here, and left everything behind.\u201d<\/p>\n\n\n\n<p>Even TPS holders not currently affected by the changes showed up in solidarity.&nbsp;<\/p>\n\n\n\n<p>\u201cToday, more than ever, we need to keep fighting, because as immigrants, we\u2019re receiving a lot of attacks,\u201d said Jhony S., a Honduran TPS holder based in Hayward. \u201cJust because someone made a mistake doesn\u2019t mean that we\u2019re all the same.\u201d<\/p>\n\n\n\n<p>Plaintiffs are urging the court to act before TPS protections begin to expire on April
