{"id":64263,"date":"2025-02-06T17:07:00","date_gmt":"2025-02-07T01:07:00","guid":{"rendered":"https:\/\/eltecolote.org\/content\/?p=64263"},"modified":"2025-02-12T14:41:53","modified_gmt":"2025-02-12T22:41:53","slug":"fencing-illegal-goods-sf-ca-bill","status":"publish","type":"post","link":"https:\/\/eltecolote.org\/content\/en\/fencing-illegal-goods-sf-ca-bill\/","title":{"rendered":"SF street vendors eye bill that would crack down on stolen goods sales"},"content":{"rendered":"\n<p>In San Francisco\u2019s latest effort to crack down on fencing \u2013 the sale of stolen goods \u2014 lawmakers are reintroducing legislation now known as the SAFE Streets Act, a California bill that has been met with both hope and hesitation among street vendors.<\/p>\n\n\n\n<p>Introduced by State Senator Scott Wiener and backed by Mayor Daniel Lurie, the bill would give police authority to lead enforcement in suspected fencing operations, a role currently held by public works officers.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-center\"><a href=\"https:\/\/eltecolote.org\/content\/es\/ca-ley-venta-ambulante-sf-mission\/\"><em>Lea esta historia en espa\u00f1ol.<\/em><\/a><\/p>\n\n\n\n<p>If passed, street vendors selling items from a list of commonly stolen goods \u2014 determined by the Board of Supervisors \u2014 would need to show a permit or proof of purchase to avoid penalties. Food vendors, such as those selling hot dogs or fruit, would be exempt \u2014&nbsp; even if they don\u2019t have a permit.<\/p>\n\n\n\n<p>Since November of 2023, San Franciscohas attempted to curb fencing through <a href=\"https:\/\/eltecolote.org\/content\/en\/mission-street-vendors-face-uncertainty-after-90-day-ban-goes-into-effect\/\">a blanket moratorium <\/a>on all street vending on Mission Street, leaving many permitted Latinx vendors without a reliable source of income. Senator Wiener said the SAFE Street Act would protect \u201clegitimate street vendors\u201d while cracking down on fencing by focusing enforcement on permitting.<a href=\"https:\/\/www.sf.gov\/news--mayor-breed-and-senator-wiener-announce-state-legislation-shut-down-sale-stolen-goods-san\"> A previous version of the bill, <\/a>endorsed by former Mayor London Breed, <a href=\"https:\/\/missionlocal.org\/2024\/08\/ca-state-bill-on-street-vending-enforcement-dies-and-sf-extends-mission-vending-ban\/\">failed to pass last summer<\/a>.<\/p>\n\n\n\n<p><strong>Mission street vendors hope for reform<\/strong><\/p>\n\n\n\n<p>Several Mission District community groups, including CLECHA and the Mission Street Vendors Association (MSVA), joined Lurie and Wiener on Monday to endorse the bill. They gathered in a packed El Tiangue, a city-leased indoor vending site that was meant to support permitted vendors displaced from selling along Mission Street, but was later <a href=\"https:\/\/abc7news.com\/san-francisco-to-close-el-tiangue-storefront-mission-street-vendors-have-been-using-during-90-day-vending-ban\/14644264\/\">closed down in April<\/a>, after failing to generate a clientele.<\/p>\n\n\n\n<p>MSVA President Rodrigo Lopez said he saw the bill as a way to \u201cempower vendors\u201d and make it easier for them to \u201csafely make a living.\u201d His group has been advocating for<a href=\"https:\/\/eltecolote.org\/content\/en\/frustrated-street-vendors-march-on-city-hall-in-protest-of-ban\/\"> permitted vendors\u2019 rights<\/a> since the ban was first enacted.<\/p>\n\n\n\n<p>Many longtime vendors hope the bill will enable a full return to legal street vending on Mission Street. Currently, only a handful are allowed to sell under a <a href=\"https:\/\/eltecolote.org\/content\/en\/mission-street-vendors-pilot\/\">city-run pilot program<\/a> launched last summer. Other Mission vendors sell goods at La Placita, a nearby market, but <a href=\"https:\/\/eltecolote.org\/content\/en\/mission-street-vendors-la-placita\/\">have complained of lower sales.<\/a>&nbsp;<\/p>\n\n\n\n<p>\u201cVending is a crucial part of our community and culture,\u201d said jewelry vendor Luz Ledesma. \u201cWhile there\u2019s no perfect solution, we\u2019re working with city and state leaders to push for changes that could better the situation in the district.\u201d<\/p>\n\n\n\n<p>Supporters of the SAFE Streets Act also hope the bill will address burglaries and violent street altercations near the 16th and 24th Street BART Plazas.<\/p>\n\n\n\n<p>\u201cIt\u2019s about time,\u201d said Roberto Hern\u00e1ndez, who is a board member of the Mission Merchants Association. To Hern\u00e1ndez, fencing on the plazas has had a \u201cripple effect\u201d on those living and working nearby.&nbsp;<\/p>\n\n\n\n<p><strong>Concerns remain over immigration risks<\/strong><\/p>\n\n\n\n<p>Although some supervisors support the bill, District 9 Supervisor Jackie Fielder, who represents the Mission, said she will not comment until she receives the full text for review. During her election campaign, Fielder<a href=\"https:\/\/eltecolote.org\/content\/en\/d9-supervisor-candidate-street-vendors\/\"> warned against further criminalization<\/a>, especially for undocumented vendors.<\/p>\n\n\n\n<p>Wiener and Lurie insist the bill was crafted to avoid immigration consequences, but critics argue that key details remain unclear. Some residents fear that, coupled with new<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/5\"> federal mandates<\/a>, the SAFE Streets Act could increase deportation risks for undocumented vendors.<\/p>\n\n\n\n<p>\u201cA vague press release claiming it addresses immigration concerns isn\u2019t enough \u2014 actual immigrant advocates must vet it,\u201d said San Francisco Latinx Democratic Club President Kevin Ortiz. He warned that increasing law enforcement involvement could also heighten police profiling of Latinx residents, calling the bill a \u201cforced compromise.\u201d<\/p>\n\n\n\n<p>Announced the same week the city <a href=\"https:\/\/www.cbsnews.com\/sanfrancisco\/news\/san-francisco-grants-mayor-daniel-lurie-unprecendented-powers-fentanyl-crisis\/\">advanced a Fentanyl State of Emergency Ordinance<\/a>, the bill is yet another reflection of Mayor Lurie\u2019s <a href=\"https:\/\/eltecolote.org\/content\/en\/what-mayor-elect-daniel-lurie-could-mean-for-s-f-s-latinx-communities\/\">broader public safety agenda<\/a>. Though the SAFE Act faces a long road to implementation, it also signals the new administration\u2019s effort to engage Latinx community leaders in policy discussions.&nbsp;<\/p>\n\n\n\n<p>\u201cWe are all coming together to make sure that we help legitimate business owners and small business vendors and people that care deeply about this community,\u201d Lurie said.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In the meantime, the Mission Street vending moratorium is set to expire in June, and officials have not indicated whether they will extend the ban again.<\/p>\n\n\n\n<p>\u201cWe hope that these aren\u2019t just words, but actions,\u201d said Juana Perez Badillo, a street vendor who sells children\u2019s toys, and who, like many others, are eagerly awaiting for a permanent return to selling on Mission Street.<\/p>\n\n\n\n<p><em><strong>Correction: <\/strong>The Latino Task Force was not among the groups that endorsed the
