{"id":63805,"date":"2024-12-26T14:51:57","date_gmt":"2024-12-26T22:51:57","guid":{"rendered":"https:\/\/eltecolote.org\/content\/?p=63805"},"modified":"2025-06-12T00:05:18","modified_gmt":"2025-06-12T07:05:18","slug":"san-francisco-rv-towing-policy-overturned","status":"publish","type":"post","link":"https:\/\/eltecolote.org\/content\/en\/san-francisco-rv-towing-policy-overturned\/","title":{"rendered":"San Francisco Board of Supervisors overturns controversial RV towing policy"},"content":{"rendered":"\n<p>San Francisco\u2019s Board of Supervisors voted 7-3 on December 10 to overturn the city\u2019s overnight towing policy, delivering a significant victory for <a href=\"https:\/\/eltecolote.org\/content\/en\/sf-rv-crackdown-weaponized-parking\/\">RV residents<\/a> and advocates fighting escalating crackdowns on vehicles used as shelter.<\/p>\n\n\n\n<p>The rescinded policy, proposed by Mayor London Breed and the San Francisco Municipal Transportation Agency (SFMTA), gave SFMTA\u2019s director unilateral authority to impose overnight parking bans for RVs and other oversized vehicles without community input. It also permitted city agencies to tow RVs parked on streets with existing bans if residents declined shelter offers.<\/p>\n\n\n\n<p>The SFMTA argued the policy was a necessary \u201c<a href=\"https:\/\/eltecolote.org\/content\/en\/sf-rv-towing-policy-nov-1\/\">tool of last resort<\/a>\u201d to keep city streets clean and accessible, but critics said it lacked transparency and unfairly targeted vulnerable families.<\/p>\n\n\n\n<p>Approved by the SFMTA\u2019s Board of Directors on Oct. 1, the policy was set to take effect on Nov. 1. However, an appeal filed by the End Poverty Tows Coalition on Oct. 29 delayed its implementation until the city\u2019s Board of Supervisors reviewed it on December 10.&nbsp;<\/p>\n\n\n\n<p>With the policy overturned, SFMTA\u2019s ability to clear RV communities from streets remains limited. Enforcement is restricted to issuing citations for parking infractions, including expired registration and breaking parking rules. Towing is restricted to emergencies or cases of blocked circulation, and it requires police intervention.<\/p>\n\n\n\n<p>If the SFMTA wants to create new overnight parking bans on specific streets, it must seek board approval and go through public comment \u2014 a process that has become increasingly politically fraught.<\/p>\n\n\n\n<p><strong>A year of RV crackdowns and displacement<\/strong><\/p>\n\n\n\n<p>The vote comes amid San Francisco\u2019s rise of vehicular homelessness. According to the city\u2019s most recent Point-In-Time Count, more than 1,400 people live in vehicles in San Francisco \u2014 an increase of 37% since 2022. The RV population includes over 117 families, many of them Latinx, including newcomers from Latin America and established immigrants who turned to living in their vehicles after struggling with the city\u2019s high cost of living.<\/p>\n\n\n\n<p>RV communities <a href=\"https:\/\/www.sfchronicle.com\/sf\/article\/homeless-families-living-in-vehicles-are-filling-17181920.php\">began forming<\/a> during the pandemic, after the SFMTA issued a <a href=\"https:\/\/www.sfmta.com\/sites\/default\/files\/reports-and-documents\/2020\/09\/covid-19_transportation_recovery_plan_level1.pdf\">temporary suspension<\/a> of parking tickets and a moratorium on towing vehicles for non-emergency reasons. When <a href=\"https:\/\/www.sfmta.com\/blog\/sfmta-resumes-peak-hour-tow-away-zone-enforcement\">enforcement<\/a> resumed in 2021, complaints from neighbors and business owners pressured the SFMTA to remove these new RVs from nearby streets, often turning these communities into political battlegrounds.<\/p>\n\n\n\n<p>In 2023, the SFMTA\u2019s efforts to remove RV communities became more difficult when the First District Court of Appeal <a href=\"https:\/\/law.justia.com\/cases\/california\/court-of-appeal\/2023\/a164180.html\">ruled<\/a> in favor of an End Poverty Tows Coalition lawsuit, stating that SFMTA\u2019s practice of towing legally parked cars for unpaid parking tickets was a \u201csignificant intrusion on property rights that may seriously impact the lives of the owners.\u201d<\/p>\n\n\n\n<p>Despite this obstacle, the SFMTA leveraged existing parking codes and construction projects to displace several RV communities on a street-by-street basis. In the past year, <em>El Tecolote<\/em> documented some of these efforts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bernal Heights Boulevard: <\/strong>A <a href=\"https:\/\/eltecolote.org\/content\/en\/sf-parking-ban-bernal-heights-boulevard\/\">neighbor\u2019s complaint<\/a> led to the <a href=\"https:\/\/www.sfchronicle.com\/bayarea\/article\/rv-homelessness-bernal-parking-san-francisco-18649472.php\">discovery<\/a> of a decades-old parking ban, prompting the city to install \u201cno parking\u201d signs and forcing about a dozen RV residents to <a href=\"https:\/\/eltecolote.org\/content\/en\/displaced-rv-community-sf\/\">relocate to nearby streets<\/a>.<\/li>\n\n\n\n<li><strong>Winston Drive: <\/strong>Political pressure led the SFMTA to use a <a href=\"https:\/\/eltecolote.org\/content\/en\/winston-drive-rv-community-sf-state\/\">planned repaving project<\/a> to displace a large community of primarily working-class Latinx families living on the street.<\/li>\n\n\n\n<li><strong>Zoo Road:<\/strong> Many of these displaced residents from Winston Drive moved to <a href=\"https:\/\/eltecolote.org\/content\/en\/winston-drive-rv-sf-zoo\/\">Zoo Road<\/a>, another street without existing overnight parking restrictions. These residents were soon forced to move again for curb painting. Amid public outcry, the city <a href=\"https:\/\/eltecolote.org\/content\/en\/displaced-rv-community-winston-zoo\/\">enrolled<\/a> some of the families living on Zoo Road into its rapid rehousing program.<\/li>\n<\/ul>\n\n\n\n<p><strong>A failed attempt to ban RVs citywide<\/strong><\/p>\n\n\n\n<p>Weeks after the city pushed to displace more than 120 vehicles from the Lake Merced area, public records obtained by <em>El Tecolote<\/em> show Mayor London Breed <a href=\"https:\/\/eltecolote.org\/content\/en\/sf-rv-oversized-vehicle-ban\/\">accelerated<\/a> a <a href=\"https:\/\/www.sf.gov\/news\/mayor-london-breed-proposes-new-city-policy-address-oversized-vehicle-parking-across-san\">citywide ban<\/a> on residential RVs in September. Facing major <a href=\"https:\/\/eltecolote.org\/content\/en\/sf-rv-ban-enforcement-challenges\/\">logistical and ethical hurdles<\/a>, the final, approved policy was scaled back to apply only to <a href=\"https:\/\/eltecolote.org\/content\/en\/sf-rv-towing-policy-nov-1\/\">certain streets.<\/a><\/p>\n\n\n\n<p>But with more than 500 families already on San Francisco\u2019s permanent shelter waitlist, the policy\u2019s aim to threaten towing to push RV residents out of informal but independent living arrangements into what would often be temporary, city-funded programs proved controversial.<\/p>\n\n\n\n<p>\u201cThis policy is hanging us out to dry. We have no shelter beds left. We have no housing vouchers left,\u201d said Hope Kamer, director of strategic initiatives at Compass SF, which connects homeless families to city services. \u201cTo force families from fragile stability into situations of unsheltered homelessness while failing to add any money to the shelter system is lazy policymaking. It\u2019s cruel and uncreative.\u201d<\/p>\n\n\n\n<p>At the December 10 board hearing, Supervisor Ahsha Safai called the policy \u201cpolitical theater\u201d and urged a \u201cmore thoughtful and timely\u201d approach to addressing vehicular homelessness.<\/p>\n\n\n\n<p>Supervisor Myrna Melgar, whose district oversaw the displacement of RVs in the Lake Merced area, said the city needed to invest in sustainable solutions for RV residents before enforcing parking rules, including creating safe parking programs.&nbsp;<\/p>\n\n\n\n<p>\u201cYou don\u2019t do the punitive measures first and then figure out a system,\u201d Melgar said. \u201cEventually I will support the parking restrictions when we have a plan to deal with them, which I don\u2019t think we have today.\u201d<\/p>\n\n\n\n<p>During public comment, RV residents, advocates and nonprofit representatives spoke against the policy, citing its potential to worsen street homelessness and strain the city\u2019s limited shelter resources. With unanimous opposition to the ban, many called for investments in safe parking sites and permanent housing solutions.<\/p>\n\n\n\n<p>\u201cLosing [my RV] is losing everything, and it\u2019s the only option we have at the moment,\u201d said Carlos Perez, a Guatemalan immigrant who has lived in San Francisco for 32 years and works to support himself and his disabled brother. \u201cI\u2019d like to have more luck, to be able to find an apartment and pay for it, but haven\u2019t had that [yet].\u201d<\/p>\n\n\n\n<p>In a city that was defined by an aggressive crackdown on street homelessness this year, advocates say the successful overturn of SFMTA\u2019s towing policy is a small victory in their fight against policies that criminalize some of San Francisco\u2019s most marginalized communities.<\/p>\n\n\n\n<p>\u201cTo the families affected by this ban: we stand wholeheartedly with you,\u201d La Raza Community Resource Center said in a joint statement with other Coalition partners on Instagram. \u201cOur fight for dignity, safety and security in San Francisco doesn\u2019t end here.\u201d<\/p>\n\n\n\n<p><strong>Correction:<\/strong> <em>Because of an editing&nbsp;error, an earlier version of this article stated that the rescinded policy permitted city agencies to tow RVs parked on streets with existing overnight bans if residents declined&nbsp;temporary&nbsp;shelter offers. The policy allowed towing if residents declined shelter offers in general, not specifically temporary
