Public records reveal doubts"},"content":{"rendered":"\n<p><strong>UPDATE: <\/strong><em>The SFMTA Board approved Mayor Breed\u2019s crackdown on RVs used as shelter<\/em><\/p>\n\n\n\n<p>San Francisco\u2019s plan to enforce a <a href=\"https:\/\/eltecolote.org\/content\/en\/sf-rv-crackdown-weaponized-parking\/\">citywide ban on RVs <\/a>used as shelter faces significant legal, logistical and ethical hurdles, according to internal documents obtained by <em>El Tecolote<\/em>. Limited enforcement resources, a lack of towing capacity and understaffed outreach programs pose major obstacles.<\/p>\n\n\n\n<p>Despite these concerns, Mayor London Breed and the San Francisco Municipal Transportation Agency (SFMTA) is pushing forward with <a href=\"https:\/\/www.sfmta.com\/media\/40607\/download?inline\">the proposal<\/a>, set for discussion at the <a href=\"https:\/\/www.sfmta.com\/notices\/public-hearing-notice-sfmta-board-directors-meeting-october-1-2024\">October 1 board meeting.<\/a><\/p>\n\n\n\n<p class=\"has-text-align-center\"><a href=\"https:\/\/eltecolote.org\/content\/es\/sf-vehiculos-recreativos-rvs-prohibicion-registros\/\"><em>Lea esta historia en espa\u00f1ol.<\/em><\/a><\/p>\n\n\n\n<p>Without clear solutions to the complex issue of vehicular homelessness, the city risks crafting a policy that functions less as a solution and more as a pressure tactic \u2014 pushing RV residents into more precarious forms of shelter or out of the city entirely.<\/p>\n\n\n\n<p><strong>Mayor\u2019s proposed plan isn\u2019t actually a citywide solution<\/strong><\/p>\n\n\n\n<p>The <a href=\"https:\/\/eltecolote.org\/content\/en\/sf-rv-oversized-vehicle-ban\/\">RV ban proposal<\/a>, drafted by the SFMTA in collaboration with the Mayor\u2019s office, would change parking rules for oversized vehicles like RVs and enable the transportation agency to tow vehicles if residents refuse shelter, in addition to receiving a $108 citation.<\/p>\n\n\n\n<p>Though the plan is framed as a citywide response to the rise in RVs used as shelter, it limits Director of Transportation Jeffrey Tumlin\u2019s authority to post overnight parking regulations only on specific streets, and can only act after submitting a report to justify the restriction in each area.<\/p>\n\n\n\n<p>\u201c[It\u2019s] a pretty obvious and direct internal contradiction,\u201d wrote SFMTA\u2019s Policy Manager Hank Wilson in <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/08-22-24_Hanks-Comment-Citywide-MTAB7-scaled.jpg\">a comment<\/a> on a <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/OV-parking-abatement-MTAB-rev-7.docx\">draft report<\/a> to the board on August 22. \u201cIf [Tumlin] can only post on the subset of streets that meet the criteria, then, by definition, it\u2019s not a citywide ban.\u201d<\/p>\n\n\n\n<p>As drafted, the proposal would maintain the city\u2019s block-by-block approach, but public hearings would no longer be required for each request to ban overnight RV parking on specific streets. This approach <a href=\"https:\/\/eltecolote.org\/content\/en\/displaced-rv-community-sf\/\">pushes RV residents<\/a> from one street to another, worsening their living conditions while frustrating new residents and businesses in the neighborhoods they move to.<\/p>\n\n\n\n<p>\u201cWe\u2019re going to get a lot more calls about this from impacted neighborhoods,\u201d wrote Wilson to his colleagues in <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/08-12-24_crack-down.jpg\">an email,<\/a> adding that neighbors are likely to say, \u201chey the Mayor says she\u2019s cracking down, can we get a crackdown here?\u201d or \u201chey your crackdown in other neighborhoods is leading to an uptick in RV parking in our part of town.\u201d<\/p>\n\n\n\n<p><strong>Understaffing undermines enforcement<\/strong><\/p>\n\n\n\n<p>The final proposal submitted to the Board expands the responsibility for engaging with vehicle residents and offering shelter to all city outreach teams. Yet according to <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/Risks-and-FAQs_internal.docx\">an internal document<\/a>, staffing shortages at the Department of Homelessness (HSH), the Healthy Street Operations Center (HSOC), and the Homeless Outreach Team (HOT) are expected to limit the \u201cspeed of progress as engagement is required before any enforcement.\u201d Additionally, there\u2019s \u201climited\u201d to \u201cno staff\u201d for all the required work to navigate people into permanent housing. Advocates have raised similar concerns.<\/p>\n\n\n\n<p>\u201cUnhoused people who live in their vehicular homes know that if they leave their homes in exchange for a shelter bed, they are more likely to end up on the streets again than in long term housing,\u201d said Lukas Illa, an organizer with the Coalition on Homelessness, <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/09-20-24_CoH-press-release.pdf\">in a statement <\/a>issued on September 20. \u201cWho would give up a home for a tent?\u201d<\/p>\n\n\n\n<p>Understaffing and budget concerns also extend to the SFMTA\u2019s sign shop, which is already strained with other duties and may not have the capacity to produce the signs needed for this citywide parking restriction.<\/p>\n\n\n\n<p>San Francisco Police Department (SFPD) <a href=\"https:\/\/missionlocal.org\/2023\/03\/police-staffing-crisis-san-francisco\/\">staffing shortages<\/a> present an even more significant challenge. Under the proposal, SFPD would be the main agency tasked with enforcing parking rules and towing vehicles overnight, potentially diverting officers from other policing priorities.<\/p>\n\n\n\n<p><strong>Towing RVs across San Francisco remains difficult<\/strong><\/p>\n\n\n\n<p>Currently, about 50 miles of streets in San Francisco have oversize vehicle restrictions.<\/p>\n\n\n\n<p>As legislated, parking infractions are not towable until streets are updated with new parking signs. Even then, vehicles can only be towed after HSH and related agencies offer shelter to residents living in them.<\/p>\n\n\n\n<p>Another major hurdle is San Francisco\u2019s limited capacity to store towed RVs, which could create logistical bottlenecks. Additionally, operable RVs may simply move to nearby unrestricted blocks, leaving the city to tow only mechanically inoperable vehicle homes.<\/p>\n\n\n\n<p>Beyond these logistical challenges, the financial burden is yet another key obstacle. Towing RVs comes with a hefty price tag. The SFMTA estimated the <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/SFMTA_7.2.54-presentation.pptx.pdf\">cost of the entire effort<\/a> would be $350,000 a year, yet <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/Recreational-Large-Vehicle-Fiscal-Impact-Analysis.xlsx\">internal data<\/a> reveals this cost would cover towing only five RVs per month and posting 360 permanent signs throughout the city, among other installation services.<\/p>\n\n\n\n<p><strong>City staffers conflicted over enforcement<\/strong><\/p>\n\n\n\n<p>Internal communications reveal that key SFMTA staff are conflicted about the practical, ethical, and legal ramifications of the proposed legislation.<\/p>\n\n\n\n<p>In the document, SFMTA staff said that <a href=\"https:\/\/www.sf.gov\/news\/mayor-london-breed-proposes-new-city-policy-address-oversized-vehicle-parking-across-san\">Mayor Breed&#8217;s public messaging<\/a> around offering shelter before towing could be practically \u201cproblematic.\u201d If the intent is to prioritize shelter offers to get people off the street, SFMTA staff recommended that the Mayor \u201ccontinue to push for more affordable housing without making [the <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/Encl-4_SFMTA-Tow-Policy-2021.pdf\">current policy<\/a>] towable and declaring it will be implemented citywide.\u201d<\/p>\n\n\n\n<p>As proposed, the legislation could also impact other oversized vehicles, such as vintage Airstreams, Sprinter vans, fishing boats, visitor campers and church shuttle buses that park overnight on restricted streets. \u201cWhat is our proposed solution to this?\u201d asked SFMTA Director of Streets Vyktoria Wise in a <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/04-22-24_other-locations-scaled.jpg\">comment<\/a>, referring to the oversize restrictions applied to all vehicles of that length. \u201cWe can\u2019t just say yes, it will get towed. Are we standing up [for] a permit program? Are we exempting certain vehicles?\u201d<\/p>\n\n\n\n<p>In a <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/08-22-24_Hanks-Comment-Towing-MTAB7-scaled.jpg\">comment<\/a>, Wilson also expressed confusion around the proposed legislation: \u201cShouldn\u2019t we just scrap [the <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/Encl-4_SFMTA-Tow-Policy-2021.pdf\">current towing<\/a>] policy, since we don\u2019t know at this point how exactly we\u2019re going to be doing towing of OVs\/RVs?\u201d<\/p>\n\n\n\n<p>SFMTA staffers raised ethical concerns about towing vehicles overnight. This approach could \u201cpresent challenges including optics,\u201d <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/07-29-24_risks-of-RVban.jpg\">read a note<\/a>, as it raises doubts about whether alternative shelter can realistically be found at that time, potentially leading to backlash from homeless advocates. Prioritizing enforcement in neighborhoods that frequently submit complaints to 311 also sparked equity concerns among staff.<\/p>\n\n\n\n<p>Notably, the restriction could affect Muni drivers and other city staff, some of whom are known to sleep in their vehicles.<\/p>\n\n\n\n<p><strong>RV ban faces a precarious road ahead<\/strong><\/p>\n\n\n\n<p>As San Francisco moves forward with its RV ban proposal, the city must address not only the practical challenges but also the legal concerns and ethical dilemmas raised by its own staff.&nbsp;<\/p>\n\n\n\n<p>SFMTA staff pointed to legal risks, noting that other cities have faced lawsuits over similar RV bans. In Mountain View, a controversial plan to ban oversized vehicles from city streets resulted in <a href=\"https:\/\/sanjosespotlight.com\/mountain-view-settles-lawsuit-over-rv-parking\/\">a legal settlement<\/a> after attorneys argued the rules were \u201cdesigned to banish the city\u2019s low-income populations.\u201d As part of the negotiations, the city agreed to reserve certain streets for RVs to park.<\/p>\n\n\n\n<p>In April, while searching for safe parking sites, SFMTA\u2019s Planner Marie Hunter wrote in an <a href=\"https:\/\/eltecolote.org\/content\/wp-content\/uploads\/2024\/09\/04-22-24_other-locations-scaled.jpg\">email <\/a>to colleagues that \u201cthe requests from residents, businesses and supervisors continue to conflict with people vehicularly housed.\u201d She pointed out that a solution needed to be found. \u201cWe need to be able to direct people impacted to a safe location where they will have some time to be connected to resources.\u201d<\/p>\n\n\n\n<p>Hunter highlighted that despite \u201cpromising conversations\u201d about potential sites, no concrete solutions have emerged, leaving staff to deal with public frustrations and mounting complaints. \u201cStaff are asked to advance projects or address specific situations with considerable conflicts,\u201d she wrote. \u201cIt really cannot continue.\u201d<\/p>\n\n\n\n<p>With the SFMTA set to review the legislation, the future of RV residents remains uncertain \u2014 and the balance between enforcing restrictions to prevent public camping and having compassion is still an unresolved debate.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>San Francisco\u2019s plan to enforce a citywide ban on RVs used as shelter faces significant legal, logistical and ethical hurdles, according to internal documents obtained by El Tecolote.<\/p>\n","protected":false},"author":88932,"featured_media":62561,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"single-feature.php","format":"standard","meta":{"newspack_popups_has_disabled_popups":false,"newspack_featured_image_position":"large","newspack_post_subtitle":"","newspack_article_summary_title":"Overview:","newspack_article_summary":"","newspack_hide_updated_date":false,"newspack_show_updated_date":false,"footnotes":""},"categories":[7],"tags":[],"coauthors":[25479],"class_list":["post-62559","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news","entry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Can SF enforce its RV ban?
