{"id":42562,"date":"2020-01-16T14:57:27","date_gmt":"2020-01-16T21:57:27","guid":{"rendered":"http:\/\/eltecolote.org\/content\/?p=42562"},"modified":"2020-01-30T17:10:35","modified_gmt":"2020-01-31T00:10:35","slug":"a-murdered-son-and-a-fathers-quest-for-truth-justice-and-peace","status":"publish","type":"post","link":"https:\/\/eltecolote.org\/content\/en\/a-murdered-son-and-a-fathers-quest-for-truth-justice-and-peace\/","title":{"rendered":"A murdered son and a father\u2019s quest for truth, justice and peace"},"content":{"rendered":"\n<p>As the dozens of supporters of Luis Alberto Qui\u00f1onez exited the Juvenile Justice Center on Jan. 10, not a single person left without embracing Rene Qui\u00f1onez, Luis\u2019 father.&nbsp;<\/p>\n\n\n\n<p>\u201cI\u2019m in the search of truth at the moment,\u201d Qui\u00f1onez told El Tecolote, whose 19-year-old son was ambushed and shot to death last September while sitting in a car with his girlfriend in San Francisco\u2019s Crocker Amazon neighborhood. \u201cWhat I want to do to honor my son\u2019s legacy is to get him\u2014at minimum\u2014recognized as a victim in all of this.\u201d<\/p>\n\n\n\n<p>For the last four months, Qui\u00f1onez has waded through pain and fear in his search for justice and answers surrounding his son\u2019s death. But Qui\u00f1onez\u2019s quest for justice reaches back five years ago to when Luis\u2014who was 14 at the time\u2014was wrongfully accused of murdering his former classmate.<\/p>\n\n\n\n<p>On Sept. 2, 2014, 14-year-old Rashawn Williams was fatally stabbed on the corner of 26th and Folsom streets after a verbal altercation between Williams and two boys, one of whom was Luis. At the time, Williams\u2019 family claimed that Luis had bullied Williams. Qui\u00f1onez is determined to correct that narrative.<\/p>\n\n\n\n<p>Williams\u2019 death and police mismanagement of the case, Qui\u00f1onez said, directly led to the killing of his son. Photo: Alexis Terrazas<\/figcaption><\/figure>\n\n\n\n<p>\u201cFrom the very beginning, there\u2019s been this narrative that juxtaposes an angel and a devil,\u201d said Qui\u00f1onez. \u201cAnd that narrative that everyone in the media ran with was created less than 24 hours after Rashawn\u2019s death. It was literally created overnight. I feel, that in its language, it justifies retaliatory street violence.\u201d<\/p>\n\n\n\n<p>Though Luis was arrested and held in police custody for five months following Rashawn\u2019s death, during which Williams\u2019 family petitioned for him to be tried as an adult, murder charges were dropped against him when surveillance video\u2014released by the late Public Defender Jeff Adachi\u2014exonerated Luis and showed that the other boy he was with actually stabbed Williams.<\/p>\n\n\n\n<p>But despite Luis\u2019 exoneration, the narrative that he was a murderous bully responsible for Williams\u2019 death had already gone viral. And the SFPD\u2019s failure to arrest Williams\u2019 true killer\u2014despite having video evidence\u2014sealed Luis\u2019 fate, Qui\u00f1onez said.<\/p>\n\n\n\n<p>Today, Qui\u00f1onez is sharing his story to clear his son\u2019s name and end the cycle of violence that led to the deaths of three young men and the incarceration of another.&nbsp;<\/p>\n\n\n\n<p>\u201cWhat isn\u2019t being told is that Luis and Rashawn had a restorative justice circle at Horace Mann in April [2014], where they sat down together and created that peace. Because the truth is, it\u2019s not bullying. These two boys were going back and forth,\u201d Qui\u00f1onez said. \u201cBut my son didn\u2019t want to bring harm to Rashawn &#8230; My son mourned for that boy. I mourned for Rashawn. I knew what was coming. I felt it. And the police department didn\u2019t do anything. He focused on hiring and training people who came from gangs.<\/p>\n\n\n\n<p>His son Luis hoped to build a similar legacy.&nbsp;<\/p>\n\n\n\n<p>According to Qui\u00f1onez, Luis was a blossoming young man who immersed himself in social justice circles. He fought for the closure of&nbsp; juvenile hall and mentored young men on their way there. He advocated at the State Capitol to create alternatives to incarceration and was a Dream Beyond Bars fellow at Oakland\u2019s Communities United for Restorative Youth Justice (CURYJ). &nbsp;<\/p>\n\n\n\n<p>\u201cEven though the same fucking system viciously punished him, my young boy had the tenacity and the strength and the fire to fight,\u201d Qui\u00f1onez said, referring to the time Luis spent in police custody prior to his exoneration. \u201cFive months they kidnapped my boy, he was in there &#8230; with people who actually killed people, with people who were charged with rape and the worst fucking crimes in our community. And these men are telling my 14-year-old, \u2018We\u2019re going to fucking rape you, we\u2019re going to kill you\u2019&#8230; So I had to work with him on that. I had to help him heal. And no one is talking about how fucked up that must have been for a 14-year-old.\u201d<\/p>\n\n\n\n<p>Qui\u00f1onez remembered the last conversation he had with his son, one where Luis revealed that he was \u2018going all in\u2019 into social justice.&nbsp;<\/p>\n\n\n\n<p>\u201cAnd I told him, \u2018Son be careful, you\u2019re going to be disappointed &#8230; social justice, this whole idea of building community, sometimes that shit ain\u2019t real, mijo,\u2019\u201d Qui\u00f1onez said. &nbsp;<\/p>\n\n\n\n<p>To that, Luis replied: \u2018Dad, it hasn\u2019t stopped you.\u2019&nbsp;<\/p>\n\n\n\n<p>\u201cThat was four days before my son was killed,\u201d said Qui\u00f1onez. \u201cHe was one of the smartest young men I\u2019ve ever known. At 19 years old he was breaking down institutional oppression and violence in ways that in my 30s I was struggling to comprehend.\u201d<\/p>\n\n\n\n<p>Qui\u00f1onez brought up Williams.&nbsp;<\/p>\n\n\n\n<p>\u201cIt was literally the day after his anniversary,\u201d Qui\u00f1onez said. \u201cAnd I\u2019m like, \u2018Mijo, you\u2019re going to run into people who signed that petition against you, who were educators, who were social justice \u201cactivists,\u201d who were \u201cwarriors\u201d for the people. You\u2019re going to run into these people who take these titles and these positions and then create more harm.\u2019\u201d<\/p>\n\n\n\n<p>Four days later on Sept. 8, 2019, Luis was with his girlfriend when he was fatally shot 10 times.&nbsp;<\/p>\n\n\n\n<p>El Tecolote spoke with a San Francisco resident who witnessed the fatal shooting, but because he has been subpoenaed by the city, he spoke with El Tecolote on the condition of anonymity. &nbsp;<\/p>\n\n\n\n<p>The resident and his wife were at home when they heard the gunfire. It occurred outside their master bedroom, and home surveillance cameras captured everything.&nbsp;<\/p>\n\n\n\n<p>After hitting the replay button on his surveillance monitor to see what had happened, the resident exited his house and encountered Luis\u2019 girlfriend, who was on the phone with a 911 operator.&nbsp;<\/p>\n\n\n\n<p>\u201cWhen I got to her, I knew that she was shot,\u201d said the resident. \u201cI looked inside the car and saw the condition the fellow was in. I sat her down and took my t-shirt off and tried to render her first aid \u2026 the police were there almost immediately.\u201d&nbsp;<\/p>\n\n\n\n<p>After staying with the woman until paramedics arrived, the resident returned to his home to watch the replay again and confirm what he had seen. Police then accessed&nbsp; the video to document what had happened.<\/p>\n\n\n\n<p>\u201cI can only tell you that I saw the entire sequence of events,\u201d the resident said.&nbsp;<\/p>\n\n\n\n<p>\u201cAnd it\u2019s something that once you see, you can\u2019t unsee it. It\u2019s a very brutal thing that happened.&nbsp; &nbsp;<\/p>\n\n\n\n<p>\u201cIt was not a random occurrence,\u201d the resident continued. \u201cIt was a culmination of a long series of events. It\u2019s really sad. It\u2019s a heartbreaking series of events that I hope ends here.\u201d<\/p>\n\n\n\n<p><strong>Justice for Luis<\/strong><\/p>\n\n\n\n<p>Qui\u00f1onez had a distrust in the police and criminal justice system long before the death of his son. The Jan. 10 pre-trial hearing for his son\u2019s suspected killer exacerbated it.&nbsp;<\/p>\n\n\n\n<p>According to Qui\u00f1onez, Judge Daniel A. Flores gave an unprecedented speech during the pre-trial hearing, addressing the large presence of community members and law enforcement.&nbsp;<\/p>\n\n\n\n<p>\u201cThen [Judge Flores] further went on to say \u2018Rene Qui\u00f1onez\u2019 \u2014 mentioning me more than once by name \u2014 \u2019had used social media as a platform to address several injustices.\u2019 And that he was attaching that posting into official court documents &#8230; that now makes me a target,\u201d Qui\u00f1onez said. \u201cI feel that that judge now put my family and my life at harm.\u201d<\/p>\n\n\n\n<p>Qui\u00f1onez has long been an outspoken critic of how police and the district attorney\u2019s office \u2014&nbsp; then headed by District Attorney George Gasc\u00f3n \u2014 handled not only Luis\u2019 death, but Williams\u2019 as well.&nbsp;<\/p>\n\n\n\n<p>\u201c[Williams\u2019] killer was known to the police,\u201d Qui\u00f1onez said. \u201cSo ask the police why wasn\u2019t he arrested. Don\u2019t just settle for \u2018There wasn\u2019t enough evidence.\u2019 That\u2019s bullshit because the same evidence that they tried to use against my son in trying to convict him for murder, that evidence is the same evidence that exonerated him but that should have been used to try Miguel.\u201d&nbsp;<\/p>\n\n\n\n<p>According to Qui\u00f1onez, Luis had met 16-year-old Miguel Alvarez a few hours before Williams was killed. Qui\u00f1onez had tried to keep Luis from hanging out on 24th Street, knowing the dangers of the street and gang-type mentality.<\/p>\n\n\n\n<p>\u201cOur family has never attacked Rashawn. But the truth is, that these three young men were all posturing in a way that led to Rashawn\u2019s death,\u201d Qui\u00f1onez said. \u201cMy intent is not to smear or defame Rashawn. I want you to understand that. The bigger issue here is there is toxic masculinity that exists within our community, and we\u2019re failing to address that.\u201d&nbsp;<\/p>\n\n\n\n<p>According to the video released by Adachi, Williams exited Rubin\u2019s Market after Luis and Alvarez had passed the store.&nbsp;<\/p>\n\n\n\n<p>\u201cAnd to quote my son, he says, \u2018Dad, Rashawn came out saying, \u2018Fuck you, this is Army Street. This is my block\u2026,\u2019\u201d Qui\u00f1onez said.&nbsp;<\/p>\n\n\n\n<p>\u201cAnd Miguel turns around \u2014 and the video can corroborate this \u2014 and they start jawing at each other &#8230; and they\u2019re about to get into it \u2026 and Miguel reached out and stabbed (Rashawn) and ran. It was a cowardly move.\u201d<\/p>\n\n\n\n<p>Though the video would corroborate Qui\u00f1onez belief that Alvarez\u2019s identity was known to the DA and police, he was never arrested. In December 2015, roughly a year and three months after Williams was killed, Alvarez was fatally shot in Bernal Heights.&nbsp;<\/p>\n\n\n\n<p>Qui\u00f1onez has been in contact with Alvarez\u2019s family and says they are \u201creally hurt\u201d and agree \u201cthat the police department was complicit in the murder of their child, because the act of charging him and possibly sentencing him alone would have prevented his life from being taken. He would be in prison, and they would be visiting him.\u201d&nbsp;<\/p>\n\n\n\n<p>As for the suspect in custody for killing Luis, Qui\u00f1onez is not convinced that he was the gunman because three other individuals who were involved are still at large. Regardless, Qui\u00f1onez isn\u2019t asking for a life sentence from whoever killed his son.<\/p>\n\n\n\n<p>\u201cI personally will not ask a minor to be charged as an adult,\u201d Qui\u00f1onez said. \u201cBut this case warrants a discussion about an appropriate sentence &#8230; I\u2019m not trying to be vindictive and punish this young man. I do believe that he may find at some stage in his life the opportunity to heal from this and to contribute to our community and to talk about healing, but I don\u2019t think he\u2019s going to do it at 24 [years of age].\u201d<\/p>\n\n\n\n<p>Still, Qui\u00f1onez can\u2019t help but feel that the police knew what would eventually happen to both Alvarez and Luis.&nbsp;<\/p>\n\n\n\n<p>\u201cMy history and my trauma may play into this idea, but I feel the police knew what would happen to Miguel, knew what would eventually happen to my son. You talk about disposable men of color; this is a perfect example of how the police department created this scenario where street justice and street vengeance would be allowed to exist.
