Photo: Brooke Anderson<\/figcaption><\/figure>\n<p class=\"p1\"><b><\/b>The end of Deferred Action for Childhood Arrivals (DACA) announced earlier this month has sent shockwaves of fear and confusion through the undocumented and immigrant rights communities, but it\u2019s also prompted massive counter<span class=\"Apple-converted-space\">\u00a0 <\/span>campaigns both to legally challenge the administration and to properly inform people of their rights.<\/p>\n<p class=\"p5\">Currently, multiple immigrant advocacy groups are gearing up for legal battle over DACA\u2019s termination.<\/p>\n<p class=\"p5\">\u201cWe are taking the administration to court to fight for all DACA recipients,\u201d said Ignacia Rodriguez, immigration policy advocate with the Los Angeles-based National Immigration Law Center (NILC), which is representing numerous plaintiffs across the country. \u201cSpecifically, we are arguing that the Trump decision to end DACA violates federal law.<\/p>\n<p class=\"p5\">Rodriguez argues that when the government reverses a long established policy such as DACA, it must show that it\u2019s doing so for good reason. And the Trump administration, she says, has violated the Administrative Procedures Act, by failing to provide the sufficient justification it requires.<\/p>\n<p class=\"p5\">\u201cThe government did not put forth an adequate rationale for reversing the policy, erroneously claiming that this is in conflict with immigration law,\u201d she said.<\/p>\n<p class=\"p5\">Rodriguez said that the administration has also violated the equal protections clause of the constitution\u2019s 14th Amendment, which prohibits discrimination on the basis of race, ethnicity, or national origin, citing a survey which found that nearly all DACA recipients are Latinos.<\/p>\n<figure id=\"attachment_35636\" aria-describedby=\"caption-attachment-35636\" style=\"width: 400px\" class=\"wp-caption alignright\"><a href=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2017\/09\/DACA-Forward_02web.jpg?quality=89&#038;ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\" wp-image-35636\" src=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2017\/09\/DACA-Forward_02web.jpg?resize=400%2C599&#038;quality=89&#038;ssl=1\" alt=\"\" width=\"400\" height=\"599\" srcset=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2017\/09\/DACA-Forward_02web.jpg?w=864&amp;quality=89&amp;ssl=1 864w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2017\/09\/DACA-Forward_02web.jpg?resize=600%2C899&amp;quality=89&amp;ssl=1 600w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2017\/09\/DACA-Forward_02web.jpg?resize=167%2C250&amp;quality=89&amp;ssl=1 167w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2017\/09\/DACA-Forward_02web.jpg?resize=768%2C1150&amp;quality=89&amp;ssl=1 768w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2017\/09\/DACA-Forward_02web.jpg?resize=320%2C480&amp;quality=89&amp;ssl=1 320w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><figcaption id=\"caption-attachment-35636\" class=\"wp-caption-text\">Protesters march down Market Street on Sept. 5 during an emergency DACA rally, following President Donald Trump\u2019s decision to end the program. Photo: Brooke Anderson<\/figcaption><\/figure>\n<p class=\"p5\">According to the largest survey to date on DACA, conducted by Tom Wong, an associate professor of Political Science at UC San Diego, 92.8 percent of its recipients identify as Hispanic\/Latino.<\/p>\n<p class=\"p5\">From the moment he announced his candidacy for president, Trump has attacked Latino immigrants. In January, he authorized the creation of the Victims Of Immigration Crime Engagement (VOICE) program, which publicized crimes committed by immigrants, focusing primarily on those from Latin America.<\/p>\n<p class=\"p5\">Another lawsuit challenging the administration\u2019s ending of DACA was filed in the eastern district of New York on Sept. 6, by 15 states including Washington, D.C. This lawsuit also argues the administration violated the due-process rights of DACA recipients by failing to safeguard the personal information that these immigrants were required to provide when they applied for DACA.<\/p>\n<p class=\"p5\">Other suits have also been filed in California (the state with the largest DACA population), including a suit by the University of California and one by the state\u2019s Attorney General Xavier Becerra.<\/p>\n<p class=\"p5\">Rodriguez said that there are various organizations pushing at both state and national levels for congress to pass bicameral, bipartisan immigration reform such as the DREAM Act 2017, which would provide undocumented youth a path to U.S. citizenship.<\/p>\n<p class=\"p5\">\u201cThe reality is that we\u2019re in an emergency situation for these young people,\u201d said Rodriguez.<\/p>\n<p class=\"p5\">But between Trump\u2019s professed alleged \u201clove\u201d for \u201cDREAMers\u201d and tweets claiming that DACA recipients \u201chave nothing to worry about,\u201d it\u2019s difficult to determine the president\u2019s intentions.<\/p>\n<p class=\"p5\">\u201cIt\u2019s hard to read the strength of a tweet [from the president] and it\u2019s hard to even interpret,\u201d Rodriguez said. \u201cSo we don\u2019t know what that means. What we want to hear\u2014if he wants to really protect these individuals\u2014is that the program will remain in place until some congressional action is taken, and not giving these arbitrary six month deadlines.\u201d<\/p>\n<p class=\"p4\"><b>What we know for sure about DACA<\/b><\/p>\n<p class=\"p4\">Since Deferred Action for Childhood Arrivals (DACA) was initiated in 2012, more than 780,000 people have registered with the program.<\/p>\n<p class=\"p5\">\u201cOver the last five years we\u2019ve seen a huge number of people register for the program and renew the benefits they\u2019ve received under the program,\u201d said Allison Davenport, staff attorney with the Immigrant Legal Resource Center (ILRC).<\/p>\n<p class=\"p5\">Despite the Trump administration\u2019s announcement, DACA is still in effect.<\/p>\n<p class=\"p5\">\u201cPieces [of DACA] would be allowed to naturally expire over the next two years,\u201d Davenport said. \u201cThe program will end, but will be phased out slowly.\u201d<\/p>\n<p class=\"p5\">The ending of DACA means different things depending on a person\u2019s situation.<\/p>\n<p class=\"p5\">Recipients currently with an approved DACA case and an approved work permit are valid until they expire and won\u2019t be revoked, but no new applications will be accepted.<\/p>\n<p class=\"p5\">\u201cAnyone who had an initial application on file on Sept. 5, those cases will be processed normally [that is, grandfathered into the program], but no new applications will be accepted,\u201d Davenport said.<\/p>\n<p class=\"p5\">The critical deadline for current recipients whose case expires in the next six months (by March 5, 2018), is Oct. 5, 2017, the last date for people to renew. The application to renew costs $495.<\/p>\n<p class=\"p5\">\u201cAnyone whose DACA case will expire after that window \u2026 are no longer eligible to renew their DACA status,\u201d Davenport said.<\/p>\n<p class=\"p5\">Current DACA recipients, including those who renew, are protected from deportation, but that protection can be revoked.<\/p>\n<p class=\"p5\">\u201cThere are some things that can happen to make someone lose their DACA status,\u201d explained Davenport. \u201cFor example, if they are convicted of a certain crime that makes them ineligible, they can lose their DACA status.\u201d<\/p>\n<p class=\"p5\">But the message Davenport wants to stress to immigrant communities affected by the decision is that people who currently have an unexpired DACA case will continue to be protected by it and can work legally until it expires. She also strongly recommended that everyone get legal consultation to understand their legal options.<\/p>\n<p class=\"p5\">\u201cThis is a really important moment for people to go and do a consultation with a quality legal service provider to understand their options,\u201d she said. \u201cBut we really want to make sure people are careful about fraudulent service providers at this time. There\u2019s so much fear and confusion in the community, we really don\u2019t want people to fall prey to fraudulent service providers.\u201d<\/p>\n<p class=\"p5\">There are many resources available to DACA recipients. Immigration Advocates Network ImmigrationAdvocates.org for instance has a national legal directory under their nonprofit tab.<\/p>\n<p class=\"p5\">Ignacia Rodriguez is urging people to visit websites like Unitedwedream.org, Weareheretostay.org and Immigration Advocates (Immigrationadvocates.org), which can provide important information such as FAQs, toolkits and pro bono legal counsel.<\/p>\n<p class=\"p5\">More local resources that recipients can take advantage of include Ready-california.org and the Mayor\u2019s Office of Civic Engagement &amp; Immigrant Affairs (Sfgov.org\/oceia)<span class=\"Apple-converted-space\">\u00a0 <\/span>as well as a host of organizations offering a range of services from workshops to legal consultation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The end of Deferred Action for Childhood Arrivals (DACA) announced earlier this month has sent shockwaves of fear and confusion through the undocumented and immigrant rights communities, but it\u2019s also prompted massive counter\u00a0 campaigns both to legally challenge the administration and to properly inform people of their rights.
