It urges the Sheriff\u2019s Department, Juvenile Probation Department, and other city agencies to opt-out of the program.<\/p>\n<p>Secure Communities allows state and local police check people\u2019s fingerprints against the Department of Homeland Security immigration databases, automatically reporting immigration violations to ICE.<\/p>\n<p>At the June 8 Board of Supervisor\u2019s meeting where the resolution was adopted, District 1 Supervisor Eric Mar compared the program to Arizona\u2019s SB1070 law, claiming that both, \u201cunfairly target immigrants and communities of color.\u201d<\/p>\n<p>ICE touts the program as \u201ca modernized approach to identifying and removing criminal aliens.\u201d But many in San Francisco, including Sheriff Michael Hennessey, think it goes too far.<\/p>\n<p>In a letter to state Attorney General Jerry Brown on May 18, Hennessey requested Brown\u2019s assistance in opting-out of the coordination with ICE, stating that he felt it conflicted with local law, specifically Administrative Code Section 12.H2, which prohibits the use of city funds to aid in immigration enforcement.<\/p>\n<p>\u201cMy department already has a system in place that reports individuals to ICE and I do not wish that it be replaced by Secure Communities,\u201d Hennessey wrote. \u201cMy department currently reports foreign-born individuals arrested on a felony crime or found during the booking process to have a felony or previous ICE contact in their criminal histories.\u201d<\/p>\n<p>Brown\u2019s response denied the Sheriff\u2019s request, citing the benefit of \u201cstatewide uniformity\u201d in immigration enforcement policy, adding that he felt t the program addressed \u201cimportant and legitimate\u201d concern.<\/p>\n<p>\u201cBecause I think this program serves both public safety and the interest of justice, I am declining your request,\u201d Brown wrote. \u201cPrior to the Secure Communities program, the name, but not the fingerprint, provided by an individual on arrest was run through ICE\u2019s database (\u2026) using fingerprints is faster, race neutral and results in accurate information and identification.\u201d<\/p>\n<p>But some in the immigrant-rights community accuse the program of being anything but race neutral.<\/p>\n<p>Mar said that Brown\u2019s response to the Sheriff\u2019s letter is legally meaningless and should be viewed in the context of Brown\u2019s political aspiration of becoming California\u2019s next governor.<\/p>\n<figure id=\"attachment_3555\" aria-describedby=\"caption-attachment-3555\" style=\"width: 319px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2010\/06\/S-Com-Meeting-0web3.jpg?quality=89&#038;ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-3555 \" title=\"Ramsey El-Qare\" src=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2010\/06\/S-Com-Meeting-0web3.jpg?resize=319%2C480&#038;quality=89&#038;ssl=1\" alt=\"\" width=\"319\" height=\"480\" srcset=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2010\/06\/S-Com-Meeting-0web3.jpg?resize=319%2C480&amp;quality=89&amp;ssl=1 319w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2010\/06\/S-Com-Meeting-0web3.jpg?resize=600%2C902&amp;quality=89&amp;ssl=1 600w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2010\/06\/S-Com-Meeting-0web3.jpg?resize=166%2C250&amp;quality=89&amp;ssl=1 166w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2010\/06\/S-Com-Meeting-0web3.jpg?w=798&amp;quality=89&amp;ssl=1 798w\" sizes=\"auto, (max-width: 319px) 100vw, 319px\" \/><\/a><figcaption id=\"caption-attachment-3555\" class=\"wp-caption-text\">District 9 Supervisor David Campos at the San Francisco Board of Supervisors meeting on June 8. Campos and eight of his fellow supervisors voted to opt out of the Secure Communities program. <\/figcaption><\/figure>\n<p>\u201cIt really has no legal basis,\u201d Mar said. \u201cIt\u2019s based on his political belief that he supports the program.\u201d<\/p>\n<p>District 7 Supervisor Sean Elsebernd, who voted no on the resolution, said he did so because he had no other choice.<\/p>\n<p>\u201cThe city of San Francisco does not have the ability to opt-out of the program. I do wish we could,\u201d he said. \u201cI don\u2019t think it\u2019s necessary in San Francisco, but this is a mandate imposed on us by the federal government and we are not in a position to oppose that (\u2026) Jerry Brown said we can\u2019t, we can\u2019t do this.\u201d<\/p>\n<p>He added that there was \u201ccertainly a possibility of racial profiling\u201d as a result of the program and that it \u201cdefinitely challenges\u201d the Sanctuary City Ordinance.<\/p>\n<p>Some groups\u2014including the American Immigration Council\u2019s Immigration Policy Center\u2014question the efficacy of the program in achieving its stated goals, particularly when it comes to prioritizing enforcement to high-risk individuals.<\/p>\n<p>ICE has stated publicly that it has a three-tier system of prioritizing risk level, with \u201clevel one\u201d being the highest, but according to an early press release, they admit that out of 111,000 individuals identified through Secure Communities only 11,000 were considered level one.<\/p>\n<p>A press release by a coalition of community groups including Dolores Street Community Services, encapsulated the concerns of the community.<\/p>\n<p>According to the release, \u201ceven if these members of our community are innocent, even if they were falsely arrested, even if they were in fact a crime victim instead of a perpetrator &#8211; there is no point of return once they are reported to ICE for deportation.
