{"id":34314,"date":"2017-06-16T11:19:02","date_gmt":"2017-06-16T18:19:02","guid":{"rendered":"http:\/\/eltecolote.org\/content\/?p=34314"},"modified":"2017-06-16T11:50:59","modified_gmt":"2017-06-16T18:50:59","slug":"resolution-sought-in-destruction-of-24th-street-mural","status":"publish","type":"post","link":"https:\/\/eltecolote.org\/content\/en\/resolution-sought-in-destruction-of-24th-street-mural\/","title":{"rendered":"Resolution sought in destruction of 24th Street mural"},"content":{"rendered":"<p class=\"p1\">[su_carousel source=&#8221;media: 34316,34317,34318,34319,34321,34320,34322&#8243; limit=&#8221;60&#8243; link=&#8221;lightbox&#8221; target=&#8221;blank&#8221; width=&#8221;800&#8243; height=&#8221;540&#8243; responsive=&#8221;no&#8221; items=&#8221;1&#8243;]<\/p>\n<p class=\"p1\"><b><\/b>The conflict surrounding the Precita Eyes mural that was literally whitewashed by artists commissioned by the building\u2019 owner on June 2, is being resolved.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/p>\n<p class=\"p5\">The exact details have not yet been made public, but after Precita Eyes\u2019 Founding Executive Director, Susan Cervantes, met with Ali Rismanchi, the owner of the building at 2801 Folsom St. on June 7, it was agreed Precita Eyes will develop a new mural at the site.<\/p>\n<p class=\"p5\">Many in the Mission community were outraged to learn that the Precita Eyes youth mural on 24th Street (near Folsom Street), which had depicted a calavera with the words \u201cOur culture can\u2019t be bought,\u201d had been buffed beyond recognition with white paint, leaving only a sliver of its original form.<\/p>\n<p class=\"p5\">Rismanchi\u2019s hired artists began painting over the mural without notifying Precita Eyes. The destruction of the mural only stopped when concerned community members and Precita Eyes artists began gathering around it.<\/p>\n<p class=\"p5\">\u201cI wanted something colorful on this, frankly. I\u2019m a fan of colors\u2014bright colors. This wall for me was way too dark,\u201d Rismanchi said on June 2.<\/p>\n<p class=\"p5\">The new design was intended to read: \u201cBe a good person,\u201d a slogan which is associated with a clothing brand of the same name.<\/p>\n<p class=\"p5\">Rismanchi arrived on scene when the crowd began to grow. Several community members, including Mission activist Nancy Pili Hernandez, told Rismanchi that whitewashing the mural was disrespectful to the neighborhood and to the youth who painted.<\/p>\n<p class=\"p5\">\u201cI didn\u2019t know I had to go through these processes\u2026 to redo the mural,\u201d Rismanchi said, in his defense. \u201dAt this time, it\u2019s done\u2026 this wall is yours.<span class=\"Apple-converted-space\">\u00a0 <\/span>It\u2019s the neighborhood\u2019s. Make it colorful.\u201d<\/p>\n<p class=\"p5\">The \u201cprocesses\u201d<span class=\"Apple-converted-space\">\u00a0 <\/span>Rismanchi claimed not to be aware of involve specific laws in place to protect murals.<\/p>\n<p class=\"p5\">\u201cTo go and paint over [the mural] is flat out a violation of federal law,\u201d said Brooke Oliver, founding attorney of 50 Balmy Law P.C., who has represented Precita Eyes and muralists.<\/p>\n<p class=\"p5\">When asked if that applied to this incident, Oliver said: \u201cAbsolutely.\u201d<\/p>\n<p class=\"p5\">Oliver explained that in the United States, protections for such a mural are specified in the federal Visual Artists Rights Act (VARA).<\/p>\n<p class=\"p5\">\u201cBasically, VARA says that an artist has the rights of integrity and attribution in an original work of art. Attribution is simply to be credited,\u201d Oliver said. \u201cRight of integrity is to have it remain whole, that [it] is illegal under federal law for anyone to deface or modify an original work of art without the artist\u2019s permission. There are some specific rules that apply when a piece of art is affixed to a building, as with this case.\u201d<\/p>\n<p class=\"p5\">Oliver explained that<span class=\"Apple-converted-space\">\u00a0 <\/span>a building owner can destroy a mural, but they must give the artist written notice and the opportunity to remove the mural from the wall at the artist\u2019s expense. Via: Instagram\/@beagoodpersonbrand<\/figcaption><\/figure>\n<p class=\"p5\">The artist at the center of the controversy is KiriLeigh Jones, who was hired by Rismanchi to paint her \u201cBe A Good Person\u201d over the \u201cOur Culture Can\u2019t be Bought\u201d mural.<\/p>\n<p class=\"p5\">In an email to El Tecolote, Jones expressed her empathy and claimed that she painted over the mural thinking that she had proper permission to do so.<\/p>\n<p class=\"p5\">\u201cIt was really unfortunate for everyone involved. To members of the community who were affected, I\u2019m empathetic. Myself, I\u2019m disappointed that I was working under an impression or understanding that was not reality,\u201d Jones said.<\/p>\n<p class=\"p5\">Precita Eyes muralist Carla Wojczuk was giving a mural tour on June 2 at around 11:30 a.m. when she saw a group, including Jones, with rollers and paint supplies standing in front of the mural.<\/p>\n<p class=\"p5\">\u201cI said, \u2018Hey you guys might want to wait on this. Because these are community murals and they\u2019re also protected, like legally,\u2019\u201d said Wojczuk.<\/p>\n<p class=\"p5\">Jones told El Tecolote that she was unaware that Rismanchi hadn\u2019t communicated with Precita Eyes or Cervantes.<\/p>\n<p class=\"p5\">\u201cAs soon as it was relayed to me that we needed to speak to them before getting started, I went and left a written message for the mural\u2019s curator with someone at Precita Eyes,\u201d Jones said.<\/p>\n<p class=\"p5\">\u201cOnce the building owner arrived, he went to speak to them as well and then relayed back to me that Susan approved us covering the side wall and that Precita Eyes would paint a new mural on the front of the building. I continued working under the impression that everyone was in agreement.\u201d<\/p>\n<p class=\"p5\">Wojczuk left the mural to finish her tour, but came back to warn them again. Via: beagoodperson.com<\/figcaption><\/figure>\n<p class=\"p5\">Jones, who is originally from Alameda but who now lives in Denver, is associated with the Denver clothing brand, \u201cBe a good person\u201d\u2014 which, according to its website, \u201cwas developed based on a passion for positivity and a brighter future we foresee within our society.\u201d<\/p>\n<p class=\"p5\">In February, the clothing brand announced via Instagram account a collaboration with Jones, who has since painted murals with the brand\u2019s slogan, including at least one in Denver in addition to the one originally planned to replace the Precita Eyes mural.<\/p>\n<p class=\"p5\">\u201cIt was not intended to be an advertisement,\u201d Jones said.<\/p>\n<p class=\"p5\">Jones ended up painting her mural on the Folsom Street side of the building because of the controversy, but by the weekend it had been defaced by taggers.<\/p>\n<p class=\"p5\">\u201cThe sad part is, I feel pretty regular about it, because this is kind of what\u2019s going on in San Francisco,\u201d said Max Marttila, one of the Precita Eyes coordinators who worked with youth on the original mural. \u201cWe really take pride in our murals. It means a lot more to us. It\u2019s really the voice of the people, especially in a time like this, post-gentrification.
