Read the article in its entirety at <a href=\"http:\/\/www.baynewsmovement.org\">www.baynewsmovement.org<\/a>]<\/em><\/p>\n<p>Civil-rights advocates concerned about \u201cdomestic spying\u201d on San Francisco\u2019s Arab, Middle Eastern, Muslim and South Asian (AMEMSA) communities are celebrating new legislation signed into law, May 9.<\/p>\n<p>Under the Safe San Francisco Civil Rights Ordinance, which will take effect by midsummer, all city and county law enforcement officers working with the FBI\u2019s Joint Terrorism Task Force will be strictly bound by local and state laws governing intelligence-gathering of First Amendment-protected activities like religious worship.<\/p>\n<p>The Board of Supervisors, which unanimously passed the ordinance, does not have the jurisdiction to influence FBI activity, but AMEMSA advocates and community members view the new legislation as part of a larger push to end what they consider unlawful federal surveillance.<\/p>\n<p>\u201cThis is a first step in a long way to go for this issue our community is facing,\u201d said Adel Somaha, a Yemen-born Arab-American civil rights activist.<\/p>\n<p>Advocates are also hopeful that the law will begin to repair the icy relationship between San Francisco law enforcement and AMEMSA communities.<\/p>\n<p>\u201cWe want to see these agents stay away from our mosques, which are places of worship, not spy stations,\u201d Somaha said. \u201cThey turn our community environment into a warzone for no reason.\u201d<\/p>\n<p><strong>Revised Ordinance<\/strong><br \/>\nMayor Ed Lee had previously vetoed a more detailed version of the ordinance, approving the final version only after direct references to existing local intelligence gathering policies and financial restrictions were removed.<\/p>\n<p>District 6 Supervisor Jane Kim, who authored the original and revised versions of the legislation, said the approved ordinance still contains the same protections, just under a broader reference to the California Constitution.<\/p>\n<p>\u201cThe new legislation doesn\u2019t include as many specifics,\u201d she said, but added that it does address the core concerns about racial and religious profiling and imposes transparency on future agreements between local police and the FBI by requiring the SFPD to fully report to the city\u2019s Police Commission on all Joint Terrorism Task Force activity.<\/p>\n<figure id=\"attachment_14534\" aria-describedby=\"caption-attachment-14534\" style=\"width: 360px\" class=\"wp-caption alignright\"><a href=\"https:\/\/eltecolote.org\/content\/2012\/05\/city-takes-first-steps-to-address-domestic-spying-by-federal-agents\/jttf_janekim\/\" rel=\"attachment wp-att-14534\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-14534 \" title=\"JTTF_JaneKim\" src=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2012\/05\/JTTF_JaneKim.png?resize=360%2C239&#038;quality=80&#038;ssl=1\" alt=\"\" width=\"360\" height=\"239\" srcset=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2012\/05\/JTTF_JaneKim.png?resize=360%2C239&amp;quality=80&amp;ssl=1 360w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2012\/05\/JTTF_JaneKim.png?resize=600%2C399&amp;quality=80&amp;ssl=1 600w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2012\/05\/JTTF_JaneKim.png?w=1021&amp;quality=80&amp;ssl=1 1021w\" sizes=\"auto, (max-width: 360px) 100vw, 360px\" \/><\/a><figcaption id=\"caption-attachment-14534\" class=\"wp-caption-text\">District 6 Supervisor Jane Kim, author of Safe San Francisco Civil RIghts Ordinance. Photo Ramsey El-Qare<\/figcaption><\/figure>\n<p><strong>Unlawful Surveillance<\/strong><br \/>\nKim said that individuals and organizations from AMEMSA communities were filing complaints about \u201cdomestic spying\u201d by the FBI as early as 2009.<\/p>\n<p>\u201cA lot of mosques are in our district, and a lot of our small business owners are of Arab and Muslim background,\u201d Kim said. \u201cOur constituents said they were fearful of harassment and racial profiling. They were really scared to come out and talk because they were afraid of being further targeted.\u201d<\/p>\n<p>Saadi Nasim, a board member of one of the mosques in Kim\u2019s district, said his congregation was one of those affected.<\/p>\n<p>\u201cWe have open-house Ramadan events where we invite everyone from the community and anyone from the government who wants to come,\u201d Nasim said. \u201cUnfortunately, someone betrayed our trust by approaching individuals and gathering information about them. That\u2019s not why we\u2019re inviting people. If you\u2019re doing that then go get a warrant.\u201d<\/p>\n<p>FBI documents obtained by the American Civil Liberties Union of Northern California, the Asian Law Caucus and the San Francisco Bay Guardian confirm FBI surveillance activities in San Francisco and other Northern California cities between 2004 and 2008.<br \/>\nNasim\u2019s mosque, Al Sabeel, is mentioned in a 2008 FBI document describing \u201cmosque outreach\u201d activities, which civil rights organizations allege gathered First Amendment-protected information.<\/p>\n<p>\u201cWe have students, business leaders and community members that have been interrogated by the FBI at home, at work, at school, at the border,\u201d said Summer Hararah, coordinator for the National Security and Civil Rights Program at Asian Law Caucus. \u201cWe know because the people that are questioned come to us.\u201d<\/p>\n<p>While local lawmakers cannot directly affect FBI activities, advocates hope the ordinance will begin to restore trust between local law enforcement and AMEMSA communities.<\/p>\n<p><strong>Careless remark has consequences<\/strong><br \/>\nIn May 2010, former Police Chief (now District Attorney) George Gasc\u00f3n, was attending a celebration breakfast for a $415 million earthquake retrofitting bond. At the event, he said that the San Francisco Hall of Justice was susceptible not only to earthquakes, \u201cbut also to members of the city\u2019s Middle Eastern community parking a van in front of it and blowing it up.\u201d<\/p>\n<p>Gasc\u00f3n made several public appearances in an attempt to explain his remark, but his efforts mostly backfired and the negative impact reverberated throughout Somaha\u2019s community.<\/p>\n<p>\u201cThe whole Arab and Muslim community was very upset and angry at those racist comments he made,\u201d Somaha said. \u201cIt cost him the trust of our community.\u201d<\/p>\n<p>Nasim said even the mosque was no longer seen as a safe place to go, adding that attendance at his mosque\u2019s youth group meetings dropped significantly after Gasc\u00f3n\u2019s statement.<\/p>\n<p>\u201cMany parents became afraid of letting their children come here because they might be getting spied on,\u201d he said.<br \/>\n\u201cIt\u2019s destruction of community, and I don\u2019t use those words lightly,\u201d Hararah said.<\/p>\n<p>The Coalition for a Safe San Francisco was formed in response to Gasc\u00f3n\u2019s comments, and members brought their concerns to the city\u2019s Human Rights Commission. The commission recommended upholding civil rights protected by the California Constitution; increasing transparency and oversight of the SFPD; and advocating against federal law enforcement, religious and racial profiling.<\/p>\n<p>The San Francisco Board of Supervisors unanimously approved the recommendations in April 2011.<\/p>\n<figure id=\"attachment_14537\" aria-describedby=\"caption-attachment-14537\" style=\"width: 360px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/eltecolote.org\/content\/2012\/05\/city-takes-first-steps-to-address-domestic-spying-by-federal-agents\/jttf_safesf_rally\/\" rel=\"attachment wp-att-14537\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-14537 \" title=\"JTTF_SafeSF_Rally\" src=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2012\/05\/JTTF_SafeSF_Rally.png?resize=360%2C239&#038;quality=80&#038;ssl=1\" alt=\"\" width=\"360\" height=\"239\" srcset=\"https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2012\/05\/JTTF_SafeSF_Rally.png?resize=360%2C239&amp;quality=80&amp;ssl=1 360w, https:\/\/i0.wp.com\/eltecolote.org\/content\/wp-content\/uploads\/2012\/05\/JTTF_SafeSF_Rally.png?w=432&amp;quality=80&amp;ssl=1 432w\" sizes=\"auto, (max-width: 360px) 100vw, 360px\" \/><\/a><figcaption id=\"caption-attachment-14537\" class=\"wp-caption-text\">Coalition for Safe San Francisco holds a rally outside City Hall on March 30, 2012. Photo Ramsey El-Qare<\/figcaption><\/figure>\n<p><strong>A Secret Agreement<\/strong><br \/>\nThat same month, the SFPD released a 2007 memorandum of understanding that it had secretly entered into with the FBI.<\/p>\n<p>The agreement expanded the abilities of Joint Terrorism Task Force officers to include the use of informants and surveillance without criminal predicate. It also gave local officers permission to infiltrate meetings of law-abiding organizations.<\/p>\n<p>SFPD Chief Greg Suhr issued an order in May that contradicted the FBI agreement, ordering SFPD officers to abide by California law and remain under the department\u2019s chain of command, but Hararah said Suhr\u2019s gesture was inadequate.<\/p>\n<p>\u201cCivil rights don\u2019t work through verbal assurances,\u201d Hararah said. \u201cWe have a Constitution. We have a Bill of Rights. It needs to be law.\u201d<\/p>\n<p><strong>The Compromise<\/strong><br \/>\nThe mayor\u2019s office reached out to the coalition the same day the board passed the original ordinance, said Nasrina Bargzie, an attorney with the Asian Law Caucus.<\/p>\n<p>\u201cThe mayor\u2019s concern was that he didn\u2019t like the level of specificity in our version of the ordinance,\u201d Bargzie said. \u201cIn particular, picking out parts of particular [police] department general orders.\u201d<\/p>\n<p>He added that the mayor was also concerned with the original ordinance\u2019s requirement that the Police Commission approve any future agreements between the SFPD and FBI.<\/p>\n<p>\u201cThe commission already has a lot of power over the chief,\u201d he said.<\/p>\n<p>Under the approved ordinance, the commission will not have the power to approve or reject future agreements. It does require the police chief to provide the commission with an annual report outlining the department\u2019s work with JTTF during the previous year.<\/p>\n<p>Regardless of the outcome, Nasim said he is proud of his community\u2019s journey throughout the process.<\/p>\n<p>\u201cIn our culture, if something happens to you, you don\u2019t come out and tell everybody, but my community is finally waking up,\u201d Nasim said.<\/p>\n<p>\u201cThat\u2019s been a great victory.
